Expedited Mediation – Terms of Service

These Terms of Service govern participation in Gillette Mediation’s Expedited Mediation option. By scheduling an expedited mediation session and/or submitting payment, each party and law firm agrees to the terms below.

1. Nature of the Expedited Mediation Service

Expedited Mediation is a streamlined, three-hour mediation session designed for two-party disputes. It is intended for matters where the parties desire a prompt, cost-controlled opportunity to negotiate and attempt resolution.

This service provides:

  • A maximum three-hour mediation session with a hard stop.

  • Availability within a compressed scheduling window.

  • Limited pre-mediation review by the mediator.

  • A flat and prepaid fee structure.

Expedited Mediation does not include extended sessions, written evaluations, post-session follow-up, or services beyond the three-hour period unless specifically agreed to in writing and paid separately.

2. Eligibility

The Expedited Mediation option is limited to:

  • Two-party cases only (plaintiff vs. defendant or claimant vs. respondent)

  • Single plaintiff and single defendant matters

  • Cases with a reasonable expectation of completing the mediation within three hours

Gillette Mediation reserves the right to decline matters that are unsuitable for the expedited format.

3. Fee Structure

The fee for Expedited Mediation is:

  • $500 per party (non-refundable)

  • Prepayment required from both sides before the mediation is confirmed

Payment must be completed by each party’s counsel using the designated Stripe payment link provided during scheduling or via automated communication.

4. Payment Requirement & Confirmation

The initiating party pays at the time of booking through Calendly/Stripe.

The opposing party receives an automated payment link.
The mediation time is not final until both sides have paid in full.

If the opposing party has not paid:

  • Gillette Mediation may send automatic or direct payment reminders.

  • The mediation may be cancelled if payment is not received within the timeframe required by Gillette Mediation.

No mediation services will be provided until both payments have been received.

5. Cancellation & Rescheduling

Because Expedited Mediations require advance prepaid scheduling availability:

  • All payments are non-refundable, including situations involving cancellation by either party.

  • If the case resolves before the session, payments are still non-refundable.

  • Rescheduling is not guaranteed and is subject to the mediator’s availability.

  • If rescheduling is possible, previously paid fees may be applied to the new date at the mediator’s discretion.

6. Hard Stop & Additional Time

This service includes a maximum of three (3) hours.

If the parties request to continue beyond the three-hour limit:

  • Additional time must be agreed to by all parties and the mediator, and

  • Billed at the mediator’s standard hourly rate,

  • Payable by the parties in a manner and split determined by the mediator.

Gillette Mediation has sole discretion to end the session at the three-hour mark.

7. Confidentiality

All communications during mediation are confidential consistent with Washington’s Uniform Mediation Act (RCW 7.07) and applicable mediation ethics standards.

Gillette Mediation does not provide legal advice to any participant.

8. No Guarantee of Settlement

Mediation is a voluntary and confidential settlement process.
Gillette Mediation makes no guarantee that the matter will resolve, fully or partially.

9. Professional Conduct

Counsel and parties must participate in good faith and in a professional manner.
Gillette Mediation reserves the right to end a session early if conduct becomes abusive, disruptive, or inconsistent with productive mediation.

10. Acceptance of Terms

By scheduling an expedited mediation, submitting payment, or participating in the session, each party and law firm acknowledges and agrees to these Terms of Service.
